Welcome to the HOWMZ website (the “Site”), operated by HOWMZ (“HOWMZ,” “we,” “us,” or “our”), based in Heber City, Utah. By accessing or using the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

The Site presents information about HOWMZ, our building system, our home designs, and related programs. All content is provided for general informational purposes. Renderings, floor plans, specifications, timelines, availability, and any figures shown are illustrative, may reflect concepts still in development, and are subject to change without notice. Nothing on the Site is a binding offer to sell a home, product, or service, and nothing on the Site creates a contract between you and HOWMZ.

Information on the Site about the HOWMZ franchising program, including any content in the partner access area, is not an offer to sell, or the solicitation of an offer to buy, a franchise. A franchise is offered only where lawful and, where required, only through delivery of a franchise disclosure document in accordance with applicable law.

Portions of the Site are restricted and accessible only with credentials provided by HOWMZ. Credentials are provided for your individual use and may not be shared. Content in restricted areas is confidential, is provided solely for your evaluation, and may not be copied, published, or distributed without our prior written consent. We may change, suspend, or revoke access at any time without notice.

You may use the Site only for lawful purposes. You agree not to interfere with the Site’s operation or security, attempt to gain unauthorized access to any portion of the Site or its systems, scrape or harvest content or data by automated means, or use the Site to transmit anything unlawful, misleading, or harmful.

The Site and its content — including the HOWMZ name, logos, and marks, and all text, designs, drawings, renderings, floor plans, photographs, videos, software, and other materials — are owned by HOWMZ or its licensors and are protected by intellectual property laws. You may view and print pages for personal, non-commercial use. No other license or right is granted, and you may not reproduce, modify, distribute, or create derivative works from the Site’s content without our prior written consent.

If you submit information through the Site — for example a contact request or a job application — you represent that the information is accurate and that you are authorized to provide it. You grant HOWMZ the right to use that information to respond to you and to operate our business. Please do not submit confidential or proprietary information you are not willing to have handled on that basis.

The Site may link to third-party websites or services. We do not control and are not responsible for their content, policies, or practices, and a link does not imply our endorsement.

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that the content is complete, accurate, or current.

To the fullest extent permitted by law, HOWMZ and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US $100).

You agree to indemnify and hold harmless HOWMZ and its owners, officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.

We may update the Site and these Terms at any time. Updated Terms take effect when posted to this page, and your continued use of the Site after posting constitutes acceptance. We encourage you to review this page periodically.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction.
